1.1 These terms and conditions govern your use of our website at kayluxtravel.com (the “Website”) and any bookings, enquiries, or purchases made through the Website.
1.2 By using our Website or making a booking through us, you accept these terms and conditions in full. Accordingly, if you disagree with these terms and conditions or any part of them, you must not use our Website or make a booking with us.
1.3 You must be at least 18 years of age to use our Website or make a booking. By using our Website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.
1.4 These terms and conditions are divided into two parts. Part A applies to all users of the Website. Part B applies additionally when you make a booking, enquiry, or purchase through us.

06 Limitations & Exclusions of Liability
6.1 Nothing in these terms and conditions will:
- (a) limit or exclude any liability for death or personal injury resulting from negligence;
- (b) limit or exclude any liability for fraud or fraudulent misrepresentation;
- (c) limit any liabilities in any way that is not permitted under applicable law; or
- (d) exclude any liabilities that may not be excluded under applicable law.
6.2 The limitations and exclusions of liability set out in this clause 6 and elsewhere in these terms and conditions are subject to clause 6.1, and govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.
6.3 To the extent that our Website and the information and services on our Website are provided free of charge, we will not be liable for any loss or damage of any nature.
6.4 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
6.5 We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
6.6 We will not be liable to you in respect of any loss or corruption of any data, database or software.
6.7 We will not be liable to you in respect of any special, indirect or consequential loss or damage.
PART B: BOOKINGS, ENQUIRIES & PACKAGES
07 Booking Enquiries & Confirmation
7.1 By submitting an enquiry, quote request, or booking form through our Website, you are making a request for us to prepare a travel arrangement on your behalf.
7.2 Submission of a form does not constitute a confirmed booking. A booking is only confirmed once:
- (a) we have issued a written booking confirmation to you by email; and
- (b) the applicable deposit or full payment has been received by us in cleared funds.
7.3 You are responsible for ensuring that all information provided during the enquiry or booking process (including names as they appear on passports, dates of travel, contact details and any special requirements) is complete, accurate, and up to date.
7.4 Kaylux Travel Agency Ltd is not liable for any additional costs, corrections, or missed departures caused by inaccurate or incomplete information provided by you.
08 Prices, Payments & Deposits
8.1 All prices displayed on our Website are stated in the currency shown at the point of quote and are per person, based on two adults sharing, unless otherwise stated.
8.2 Prices are subject to change until a booking has been confirmed in writing and the applicable deposit has been received.
8.3 A non-refundable deposit is required to secure your booking. The balance of the total cost must be paid no later than the date specified in your booking confirmation, typically eight (8) to twelve (12) weeks before travel, depending on the destination.
8.4 If the balance is not paid by the due date, we reserve the right to cancel your booking and retain the deposit.
8.5 Prices do not include (unless expressly stated): visa fees, travel insurance, tourist taxes, resort fees, government levies, personal expenses, tips, optional excursions, or any items not specifically listed as included.
8.6 Payment methods accepted are stated at the point of checkout or on your booking invoice. We do not accept liability for delays in booking confirmation caused by delayed payments.
09 Changes & Cancellations
9.1 Changes and cancellations initiated by you are governed by our Refunds & Cancellation Policy, published on our Website.
9.2 We reserve the right to make minor changes to your booking without notice or compensation. Where a significant change becomes necessary (such as a change of accommodation, itinerary, or travel dates by more than 24 hours) we will notify you as soon as possible and offer, where feasible, an alternative arrangement of similar value or a refund of amounts recoverable from suppliers.
9.3 In the event that Kaylux Travel Agency Ltd or a supplier must cancel your booking due to circumstances beyond our reasonable control (including but not limited to natural disasters, political unrest, pandemics, airline strikes, or government-issued travel restrictions), we will refund all recoverable amounts but will not be liable for consequential losses.
10 Your Responsibilities as a Traveller
10.1 It is your sole responsibility to ensure that:
- (a) your passport is valid for the required duration (typically six months beyond your return date, unless otherwise specified);
- (b) you hold all necessary visas, permits, and authorisations (including ETIAS, EES, e-Visa, e-VOA, and digital arrival cards where required);
- (c) you meet all applicable health, vaccination, and insurance requirements for your destination;
- (d) you comply with all local laws and customs at your destination;
- (e) you arrive at all check-in points at the required times.
10.2 We provide guidance and information where possible, but we are not responsible for any denied boarding, refused entry, additional costs, or missed departures resulting from your failure to meet these requirements.
10.3 We strongly recommend that all travellers purchase comprehensive travel insurance at the time of booking. Kaylux Travel Agency Ltd is not an insurance provider and cannot be held liable for any losses arising from a lack of, or inadequate, travel insurance.
11 Supplier Responsibility
11.1 Where we arrange components of your trip through third-party suppliers (including airlines, hotels, tour operators, transfer companies, and other travel providers), those services are subject to the terms and conditions of the individual supplier.
11.2 Kaylux Travel Agency Ltd acts as an intermediary between you and these suppliers. Where a supplier fails to deliver the service booked, our liability is limited to the amount we are able to recover from that supplier on your behalf.
11.3 We are not responsible for the acts, omissions, or default of any supplier, but we will make reasonable efforts to assist you in resolving any issues that arise.
12 Complaints Procedure
12.1 If you have a complaint about any element of your booking or travel arrangements, you must notify us as soon as possible so that we can attempt to resolve the matter promptly. Complaints should be sent in writing to support@kayluxtravel.com within 28 days of the end of your trip.
12.2 We will acknowledge receipt of your complaint within seven (7) working days and provide a full response within 28 working days wherever possible.
12.3 Complaints not raised in a timely manner may affect our ability to investigate and resolve the matter fully.
13 Marketing Communications
13.1 By making a booking or submitting an enquiry, you may receive booking-related communications from us that are necessary to fulfil your travel arrangements.
13.2 We will only send you marketing communications where you have opted in to receive them. You may unsubscribe from marketing communications at any time via the link in each email or by contacting us directly.
GENERAL PROVISIONS
14 Breaches of These Terms
14.1 Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:
- (a) send you one or more formal warnings;
- (b) temporarily suspend your access to our Website;
- (c) permanently prohibit you from accessing our Website;
- (d) block computers using your IP address from accessing our Website;
- (e) contact any or all of your internet service providers and request that they block your access to our Website; and/or
- (f) commence legal action against you, whether for breach of contract or otherwise.
15 Variation
15.1 We may revise these terms and conditions from time to time.
15.2 The revised terms and conditions shall apply to the use of our Website from the date of publication of the revised terms and conditions on the Website, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these terms and conditions.
16 Assignment
16.1 You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.
16.2 You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.
17 Severability
17.1 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
17.2 If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
18 Entire Agreement
18.1 Subject to clause 6.1, these terms and conditions, together with our Privacy Policy and Refunds & Cancellation Policy, shall constitute the entire agreement between you and us in relation to your use of our Website and any bookings made through us, and shall supersede all previous agreements between you and us in relation to the same.
19 Law & Jurisdiction
19.1 These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.
19.2 Any disputes relating to these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
